Nelson Rolihlahla Mandela, popularly known as Madiba in South Africa, turned 90 on July 18. Read more about him in this link.

Madiba on a stamp issued by the former USSR . . . the 10 kopek (1 rouble = 100 kopecks) stamp issued in 1988 reads Fighter for freedom of Africa - Nelson Mandela . . .

Madiba is one of the greatest leaders to have walked upon the Earth. Everyone knows about his struggle against the despicable system of racial segregation and discrimination called apartheid and his role in building a democratic South Africa. He is not power hungry and left the stage after a single term as the President of South Africa. Even after retirement from politics, he has always fought for issues that are close to his heart - Truth and Reconciliation in South Africa, the fight againt HIV/AIDS and Human Rights. What makes him a great human being and a true patriot is that he acknowledged the Human Rights violations by his own party during the anti-apartheid struggle in order to assist the Truth and Reconciliation process in his beloved country. Even on his 90th birthday, he has spoken about the need to fight poverty and inequality and has criticised rich and powerful South Africans for not doing enough to help their less fortunate fellow citizens. Madiba is also a strong supporter of Ubuntu.

Madiba is a person who will fight injustice and disgusting systems and practices and till his very last breath! The Earth needs many more true world leaders and great human beings like Madiba! Belated birthday wishes, Madiba!!!

MIAMI, June 26 (UPI) -- A Washington woman said she filed a federal lawsuit accusing a Miami hospital of "anti-gay animus" after workers refused to let her see her dying partner.

Janice Langbehn and her partner Lisa Marie Pond, both aged 39, intended to enjoy a vacation cruise with three of their four children, marking the women's 18 years as a couple in February 2007, the South Florida Sun-Sentinel reported Thursday.

The trip abruptly ended when Pond had a massive stroke as the ship was preparing to leave port, the newspaper said.

She was taken to Miami's Jackson Memorial Hospital, where Langbehn said workers would not let her see her ailing partner.

A social worker allegedly said the couple was in an "anti-gay city and state."

Pond died about 18 hours after she arrived at Jackson's Ryder Trauma Center.

Langbehn said she was permitted to see Pond for no more than about five minutes.

The suit, lodged in U.S. District Court in Miami, seeks at least $75,000 and accuses physicians Alois Zauner and Carlos Alberto Cruz and social worker Garnett Frederick of negligence and "intentional infliction of emotional distress."

A nota de prensa leva por título "Thailand: Stop Forced Returns of Karen Refugees to Burma. Civilians Forced Back Into Conflict Zone, More Returns Threatened". Copio un extracto do seu contido:

Thai security forces should immediately stop forcing Karen refugees and asylum seekers to return to Burma from refugee camps in Thailand, HRW said today.

The Karen, an ethnic group who have fled armed conflict and human rights violations in Burma, face persecution and violent reprisals by the Burmese military government if forced to return, HRW said.

“Forcing civilians back into an active war zone may be an easy answer for Thailand, but it’s brutal – a completely inhumane and unacceptable solution,” said Brad Adams, Asia director at HRW. “The Thai government should cooperate with international relief agencies and UNHCR to ensure that it upholds the rights of civilians under international law.”

On July 17, local Thai paramilitary forces, the tahaan prahn (literally “hunter-killer soldiers”) rounded up 52 Karen from two refugee camps in Thailand’s Mae Hong Son province along the Burma border, 39 – mostly women and children – from Mae Ra Ma Luang refugee camp and 13 from Mae La Oon camp. They permitted 17 students to stay on the Thai side, but sent 35 refugees across the border to the Ei Tu Hta relocation site in Burma. [...]

Although Thailand has not signed the 1951 Refugee Convention, it is bound by the principle of non-refoulement, a firm prohibition in customary international law on returning refugees to any country where they are likely to be persecuted or their lives are at risk. [...]

More than 50,000 civilians have fled or been displaced by the army offensive against civilians in Eastern Burma, which has been ongoing since 2006. They join more than half a million internally displaced civilians in Eastern Burma. The offensive in Eastern Burma is the largest operation by the Burmese military in several years. It has been denounced by international groups, including the International Committee of the Red Cross (ICRC), in a June 2007 statement, and Amnesty International in a June 2008 report.
(AFP)

LONDON - The British government should no longer accept US assurances that it does not use torture, a parliamentary oversight committee said on Sunday in a wide-ranging report looking at London's human rights policy.

Ministers have previously taken at face value statements from their US counterparts, including Secretary of State Condoleezza Rice and President George W. Bush, that Washington does not resort to such practices.

But the cross-party foreign affairs committee said that stance should be abandoned given admissions from the US director of national intelligence, Michael McConnell, that "water-boarding" had been used on terror suspects.

Foreign Secretary David Miliband has told parliament on two occasions this year that the practice, which simulates drowning during interrogation, amounts to torture.

Miliband's position has "serious implications" for government policy, the committee said in its 214-page Human Rights Annual Report 2007-8.

"We conclude that, given the clear differences in definition, the UK can no longer rely on US assurances that it does not use torture, and we recommend that the government does not rely on such assurances in the future," it added.

Britain is a signatory to a United Nations convention that prevents the extradition of suspects to countries where torture is used. If adopted, a change in approach could affect such transfers.

The committee also called for Britain to carry out an "exhaustive analysis" of US government interrogation techniques and seek guarantees about whether US flights carrying terror suspects used British airspace or airports.

Earlier this year, the United States admitted that two "rendition" flights landed on Diego Garcia, a British overseas territory in the Indian Ocean where there is a US air base.

Britain, whose policy is not to allow such transfers where there is a risk of torture, had earlier accepted assurances that its territory had not been used for the extra-judicial transfer of suspected extremists.

Such flights should not use British territory or airspace, even if no detainees were on board, the committee said.

Elsewhere, the committee urged an investigation into claims that six British nationals were detained and tortured by Pakistan's Inter-Services Intelligence (ISI) agency and interrogated by British security agents.

The BCHRC organised a 3 days workshop at the Hotel Seri Malaysia, PD since Friday. All participant

The BCHRC organised a 3 days workshop at the Hotel Seri Malaysia, PD since Friday. All participants (including myself) stayed at the hotel, ate, drank, learned and had fun together. The idea of human rights ingrained in the concept of democracy - "government of the people, by the people, for the people" - was primary in the minds of us. The local leaders and politicians felt that they have improved the problem of human rights issues progressively in Malaysia today. But they are mistaken. The subject is still much debated and disputed.

But it has gone beyond the need to provide fairly among the citizens of the country irrespective of race, religion and creed. Since becoming a member of the United Nations, Malaysia has to observe the Universal Declaration of Human Rights adopted by the United Nations in 1948.

Human rights cover a very broad range of subjects among the most basic of which are that human beings are born equal and they have certain god-given rights such as the right to education, basic amenities and the choice of who should be entrusted with the responsibility of running the country. During the workshop several speakers were invited to speak on topics such as fundamental liberties, civil/syariah jurisdiction, access to justice, orang asli rights, refugees & migrant workers, abuse of police powers (Anwar's scenario?) etc.

Like many other countries, this country has had to balance between democracy and national security. While the government has not openly dispensed with democracy, in most instances when faced with a choice between observing the principle of human rights as enshrined in the Universal Declaration of Human Rights and ensuring national security, it is the latter that consistently gains priority.

But ultimately to uphold human rights, there must be integrity in the management of the country, from the upper echelon of the society to the grass roots level. Stability in a society and progress can become a reality only when each person behaves correctly rather deviously. Then only can it be expected that a nation will always give priority to the interests of the people irrespective of race, creed or religion.

Sometimes I can't really blame the public's perception that the human rights NGOs, commissions and the Bar Council as pro-opposition because it is the enforcer/administrator who is likely to violate the principles of human rights.

P/S: Congratulations to Francis and Chee Yan at the Subang division. Both Chongs, a conicidence?

Their crime, being poor, and daring to walk the public streets & spaces

Security guards in Vancouver are discriminating against the city’s homeless by telling people sitting or sleeping on benches to move along, to stop binning in alleys, and by following and intimidating them.

In response to the tactics of the so called "Goodwill Ambassadors",an initiative of the Downtown Vancouver Business Improvement Association (DVBIA).

The good people of Pivot legal society & United Native Nations have filed a complaint with the BC human Rights Tribunal.

Laura Track, a lawyer with Pivot, said the Downtown Ambassadors program, which is run by Genesis Security and the DVBIA, under the guidance of commissioner Geoff Plant, singles out street people and impedes their legal access to public areas.

The downtown core and in particular the DTES & Granville street happens to be home to nearly all Vancouver's 6-7000 SOR's(single occupancy rooms). Therefore if one is unemployed, disabled, living on welfare, trying to survive on minimum wage etc the chances of one ending up in the DTES are quite good.

Imagine leaving your room to walk the street or to just sit ,along comes some junior g-man in a dorky red outfit telling you to move on,like you're some kind of dog.Or worse...

the guards follow and stare at people they find "undesirable" and take photographs and notes for unknown purposes.

Not because you have done anything wrong but because you are poor .Also if you happen to be native you are even more likely to be harassed

To add insult to injury...

The monies being used to fund, what is in affect a private business program aimed at forcing the poor from Vancouver's public spaces & streets, are public funds.

Non-Partisan Association councillors “ignored council process and staff recommendations” to force public funding for a private business program through Vancouver City Council, a Vision Vancouver media release has alleged.

The report of the US Department of State on the post-election situation in Arm

Yerevan
Vadim NOVIKOV
The report of the US Department of State on the post-election situation in Armenia has roused indignation of the Deputy Armen Ashotyan, representing the party in power. At the press-conference on June 5 he noted that only the data of the oppositionists had been used while preparing the report.

“If to look at the text of the paper, one shall notice that it consists of two parts. The first one is criticizing the state of the democratic institutions in Armenia, and in the second – the US Department of State is reporting back to its taxpayers on the work, allegedly carried out for the development of democracy in Armenia”, - the deputy stated. Ashotyan stressed the fact that the report had been prepared on the basis of the research of the monitoring group, which was several times less in its membership than that of the European observers, which gave reasons for doubting the professionalism of that group. All the more so, as analogous European groups gave rather positive appreciations to the election processes in Armenia.
Not intending to doubt the leadership of the US in what concerns democracy, and moreover, to compare this state to Armenia, Ashotyan nevertheless reminded of “some peccadilloes” of the American authorities, taking as grounds the publications of the American press and the reports of the “Freedom House”. He mentioned the resisters of hostilities in Iraq and Afghanistan, the cases of mass murders and high rate of criminality, the frustrated and “non-democratic in its essence” (as noted by the “Freedom House”) election system, the priority of the acting Governors during the elections, the racial, religious and other kinds of discrimination in the USA.
On the same day the Prosecutor General of the country Agvan Ovsepyan was speaking before the Parliamentarians at the National Assembly. He blamed the opposition for using children “in their purposes”. A.Ovsepyan stressed that small children had been in the tents on the Square of Freedom on March 1. According to him, the matters went so far that “one of the girls, escaping with her father, did not have time to put on her shoes; and later some woman-instigator stated that the girl has been killed”. Ovsepyan preferred not to answer the question of the oppositional deputies on “from what or from whom had been so hurriedly escaping the girl and her father”. The Prosecutor General has also refused to demonstrate to the public before the end of the investigation all the videos they had at their disposal, showing the events of the morning and evening of the 1st of March without the montage. He stated that such videos existed, that they had been examined by the Office of the Public Prosecutor, and would serve as material evidence, showed only at the Court. “We do not wish to be busy with the moral propaganda activities and show them to the public”, - stressed he.
Responding to the question of the Parliamentary Deputy if a criminal case had been brought in action on the fact of murders on March 1, the Prosecutor General stated that he was not going to answer those kinds of questions, motivating it with a law, prohibiting holding hearings on criminal cases. The Deputy specified that he was not speaking of definite persons, but of the very fact of presence or absence of the accused for the murders on 1-2 March and inquired whether there were people, acknowledged to be legal successors of the victims. “This I will not tell you”, - stressed Ovsepyan. Nevertheless, when later responding to the question of another Deputy Ovsepyan noted that he did not assert that all the police officers had kept within the law. “Investigation is being held on these facts”, - he assured.
We shall see what will be heard from the camps of the authorities and the opposition, when the President S. Sarkisyan, after returning from Russia, gives his appreciation of the negotiations in St. Petersburg – with the President of the Russian Federation D. Medvedev and the President of Azerbaijan Ilkham Aliyev. To our viewpoint, since now the life of the Republic will be mostly determined by the real results, being achieved by the Armenian leader at the informal summit of the CIS countries.

Dear Compatriots,
Today is the 100th -day of my activity in the position of the President of the Republic of Armenia. Hundred days, which is a symbolic chance to sum up the works done, and to highlight over again the agenda of the priorities for the development of our country. The previous 100 days were aimed at touching upon the expectations, hopes and demands of thousands of our citizens. To create grounds for the continuation of those changes, which are the direct imperatives of the country’s future development.
The conversation is about all the spheres of activity: internal and foreign policy, the perfection of the security and armed forces, the police and the judicial system, productive economic policy, including tax and customs service. There are spheres, where, in a short period of time, we managed to record success. In all the other spheres the results will very soon be visible.
I have started to put into operation my program which most of you have approved, which includes settlement of many concrete and important issues. The previous 100 days showed that we will manage to solve most of them much earlier than we expected and we will need a long period of time to settle some of them, a long period, but not more than we have planed.
Believe me I’m not saying that you must wait, because even I can’t wait. I want to see all the problems solved as soon as possible. I want to see the positive results of the struggle against injustice, indifference and poverty.
At the end of the 100 days of my term of office I would like to appeal to you to answer to one question: “What changes have you noticed during this period of time?”
Unfortunately some people are very pessimistic about the changes made in the country. With my consistence I’m trying to change their pessimism. Our work won’t be limited to 100 days. This working style will turn into a norm.
Dear compatriots,
I have always been in touch with you, openly and sincerely. And today I’m as sincere as usual. But we need to be optimistic to realize our programs.
Even when you do a small job you must be well disposed. As a society we must try to realize big programs, make big changes, and appreciate our country’s development process.
You must remember that you are the citizens of independent Armenia and today we are writing the new page of our history. And the history doesn’t depend on the President only. Our children and grandchildren will also participate in it.
My desire and goal is to see them living in free, democratic, and developed Armenia.
We will create that Armenia together.”

As long as I am trying to remember why I got into blogging by reorganizing this site and indexing go

As long as I am trying to remember why I got into blogging by reorganizing this site and indexing good series (and finishing series), etc., I should highlight the great times I have had participating as a guest blogger in others' series. One of those was the 6 part series, My Peace I Leave Unto You. This was a series of guest posts on Christian pacifism in different church traditions hosted by Halden at the blog, Inhabitatio Dei (Latin for "Living in God," or "Inhabiting God.") The six posts, all autobiographical, covered Christian pacifism in the Restoration or Stone-Campbell movement; a Reformed/Congregationalist pacifism; an Anabaptist-leaning Baptist pacifism (mine); Christian pacifism from a non-denominational, U.S. evangelical (Wheaton College) perspective; a Free Church pacifism; and an Eastern Orthodox pacifism. You can find all six posts here. I reprint mine below. I enjoyed all of them and hope Halden will restart the series, recruiting authors who are (a)female, (b) from outside the Anglo-American world, (c) Catholic, etc.

Gospel Nonviolence: An Anabaptist-Baptist Approach

A guest-post by M. L. Westmoreland-White

When Halden asked me to contribute to this series, I suddenly felt as if I was failing to heed the Petrine command to “always be ready to make your defense to anyone who demands an accounting of the hope that is in you (1 Peter 3:15b).” Do I really know what “my tradition” of Christian pacifism looks like?

The problem is that I was not raised in a peace church tradition, and my denomination, the Baptists, have never been a “peace church,” though we have always had a pacifist minority. That minority has been larger or smaller, less influential or more, in various times and places–but always a minority. (For a survey of this tradition see Paul R. DeKar, For the Healing of the Nations: Baptist Peacemakers[Smyth & Helwys, 1993.]) I came to gospel nonviolence from the U.S. military, so my “pacifism” may be a reaction, a rebellion, as much as a theological tradition. I was not formed in nonviolent virtues like a Mennonite, Quaker, or member of the Church of the Brethren would have been. So, I feel unworthy to participate in this series. But here goes, anyway.

Baptists began as radical Puritans who were influenced at key points by Dutch Anabaptists. The General, or more Arminian/Free Will, Baptists began earlier (1609-1611) with John Smyth and Thomas Helwys and were influenced by Waterlander Mennonites from Amsterdam. The Particular, or more Calvinist, Baptists (who were to become the dominant strand) began a generation later (1638-1644) and were influenced by Collegiant Mennonites (and a translation of Menno Simons’ Foundation-Book) from Leiden. From the Anabaptists, we Baptists took a radically Christocentric orientation and an emphasis on a visible church and active discipleship. From the Reformed/Puritan heritage, we took a strong emphasis on God’s Sovereignty and Christ’s Lordship over all of life (thus rejecting either Lutheran or Anabaptist “two-kingdoms” thinking).

Both those strands inform my pacifism. Because Christianity is “following after” Jesus Christ, I must love my enemies and be an active peacemaker. The Anabaptist heritage (mediated to me especially, but not only, via John Howard Yoder) keeps my pacifism centered in the Sermon on the Mount and the rest of Jesus’ teachings. It means that my refusal to kill is part of a larger pattern of non-conformity to “the world.” That pattern includes simplicity of living (striving against materialist consumerism), radical egalitarianism in home, church, and society (resisting the heirarchies of race, class, gender, and sexual orientation), mutual servanthood, economic sharing. The Anabaptist orientation means that I cannot separate my love of God (my “spiritual life” or piety) from my love of neighbors–and that I must continually recognize personal, communal, or national enemies as tests of the seriousness of that neighbor love.

Because God is Sovereign and Christ is Lord over ALL of life (not just Lord of the Church or of some “inner realm”), then my nonviolent witness cannot be apolitical. The Baptist defense of “separation of church and state” is not out of any Lutheran “two-kingdoms” theology in which God works through the state with a radically different ethic (the Left hand of God, as Luther put it) from the ethic of personal relations in which the Gospel is to be followed. The idea that “religion and politics have nothing to do with each other” is heresy. Rather, we Baptists (at our best) defend the institutional separation of church and state precisely so that the church is free to give prophetic witness to the state.

Baptists, at least, non-fundamentalist Baptists, are fond of self-descriptions that use a set of principles, axioms, or “identity markers,” rather than by reference to a formal “creed” of confession of faith. Though, unlike our “cousins” in the Stone-Campbell movement, we Baptists have often written confessions of faith, we have seldom treated them as creedal “tests of orthodoxy,” but as guides to biblical interpretation and witnesses to outsiders of our faith. We have often given these statements elaborate “preambles” that deny their creedal status and explicitly claim that they are not to be used as substitutes for simple faith in Christ and that they are always subordinate to biblical authority. Many Baptists have identified with the Restorationist motto of “No Creed but the Bible,” whatever other disagreements we have with those we often term “Campbellites.”

Consider one widely popular such list of “Baptist identity markers”:

Biblicism, understood not as preference for one or another theory of inspiration (or “inerrancy”), but as the humble acceptance of the authority of Scripture for both faith and practice and accompanied by a Christocentric hermeneutic. (This is related to the Baptist “primitivism” which desires to replicate “New Testament churches.”)

Liberty, understood not as the overthrow of all authority for an anarchic individualism, but as the church’s God-given freedom to respond to God without the intervention of the state or other Powers. (Related themes are intentional community, voluntarism, “soul competency,” and separation of church and state.)

Discipleship as normative for all Christians and so understood neither as a vocation for the few nor an esoteric discipline for adepts, but as life transformed into service by the lordship of Jesus Christ. (Signified by believers’ baptism–usually by immersion to signify the believer’s identification with Jesus’ life, death, and resurrection to new life; related themes are “the rule of Christ,” and “the rule of Paul.")

Community, understood not as some group’s privileged access to God or to sacred status, but as sharing together in a storied life of witness to Christ exercised in mutual aid and in service to others. (Signified by Communion or Holy Eucharist, most often called by Baptists the Table or Supper of the Lord; a related theme is the regenerate or believers’ church, i.e., the concern for churches of “visible saints.”)

Mission or evangelism, understood not as an attempt to control history for the ends we believe to be good, but as the responsibility of all Christians to bear witness to Christ–and to accept the suffering that such witness often entails. (The deep missionary impulse is connected to claim that all true faith is voluntary and uncoerced and thus leads back again to the defense of liberty of conscience for all–including for those whose views we deem wrong or even wrongheaded.)

Now, I do not claim that pacifism or gospel nonviolence is entailed or demanded by any vision formed by such identity markers. That claim is too strong considering how many non-pacifist Baptists there are! Rather, my (slightly more humble) claim is simply that gospel nonviolence fits such a vision and that each of these “identity markers” are strengthened and their unity more apparent in pacifist perspective. If space permitted, I could run through each marker and spell out the pacifist implications, but I leave that to the reader’s own reflections. It is my rather audacious claim that the pacifist minority among Baptists for our 400 years have had it right: That gospel nonviolence makes us more authentically Baptist, as well, of course, as more authentically Christian.

So “my” pacifism has a deeply “Baptist” shape as well as ecumenical influences. It is informed by the Social Gospel of Walter Rauschenbusch and the writings of Martin Luther King, Jr. (both Baptists), as well as from the nonviolent strands of liberation theologies. I deeply adhere to a saying from Pope Paul VI, “If you want peace, work for justice.” Biblical peace, shalom, is a product of justice–of right relationships throughout society. So, “my” pacifism, must always be an activist peacemaking: Engaging in nonviolent struggle for a better world–not in a vain attempt to “bring in the Kingdom,” (God does that–although God may use us as instruments), but to bear witness of God’s character and actions for redemption–and, to prepare the way for the Ultimate realization of God’s Reign by penultimate actions for a relatively just and peaceful world. (See Bonhoeffer’s Ethics).

It has been said that Baptists are “practical idealists.” Insofar as I belong to a tradition of Christian pacifism, it is one informed by the practical idealism of the Anabaptists of the 16th C., the “democratic” impulses of early Baptists like Thomas Helwys, Roger Williams, John Bunyan, and Richard Overton; the Levellers of the 17th C., 19th C. abolitionists and evangelical feminists, of Social Gospel and Civil Rights radicals, and of nonviolent struggles for justice globally. With such “practical idealism” I try to bear witness to the nonviolent Christ who is my Lord.

PC Graham Cogman of Norfolk Police refused to wear gay ribbons supporting gay and lesbian members of his local community while attending a gay and lesbian event and is taking his force to an Employment Tribunal for harrassment. Mr Cogman attends his local Church of England church with his family in Sea Palling, North Norfolk, and says 'he had been subject to a series of investigations over complaints that he is homophobic, turning his life into a ‘nightmare’.

The 49-year-old father-of-two, who joined the Norfolk force in 1993 after 12 years in the RAF, insists he loves his job but said: ‘Internal politics are making it difficult to do what we should be doing.’

He added: ‘We get more flak from inside the force than outside these days.

'The blatant support for homosexual rights in Norfolk Police makes being a Christian officer extremely difficult.

‘I am not undertaking this action lightly but I have to make a stand when things become so blatantly biased against me just because I hold a faith.’'

Another case of a Christian who cannot square his religious beliefs with his job. This is beginning to look like an organised witch hunt against gays and lesbians perpetrated by the Christian church.

Newsweek has investigated in depth the shooting of teenager Larry King while he was in his class. It

Newsweek has investigated in depth the shooting of teenager Larry King while he was in his class. It makes upsetting reading, so be warned.

'Brandon, 14, wasn't working on his paper, because he told Mrs. Boldrin he'd finished it. Instead, he opened a history book and started to read. Or at least he pretended to. "He kept looking over at Larry," says a student who was in the class that morning. "He'd look at the book and look at Larry, and look at the book and look at Larry." At 8:30 a.m., a half hour into class, Brandon quietly stood up. Then, without anyone's noticing, he removed a handgun that he had somehow sneaked to school, aimed it at Larry's head, and fired a single shot. Boldrin, who was across the room looking at another student's work, spun around. "Brandon, what the hell are you doing!" she screamed. Brandon fired at Larry a second time, tossed the gun on the ground and calmly walked through the classroom door. Police arrested him within seven minutes, a few blocks from school. Larry was rushed to the hospital, where he died two days later of brain injuries.'

But this article is a milestone in journalism which requires close attention for all of us. It coins the new term the shrinking closet:

'What you might call "the shrinking closet" is arguably a major factor in Larry's death. Even as homosexuality has become more accepted, the prospect of being openly gay in middle school raises a troubling set of issues. Kids may want to express who they are, but they are playing grown-up without fully knowing what that means. At the same time, teachers and parents are often uncomfortable dealing with sexual issues in children so young. Schools are caught in between. How do you protect legitimate, personal expression while preventing inappropriate, sometimes harmful, behavior?'

Mainly, by getting involved and normalising and integrating it, instead of ignoring it and hoping it will go away.

Lawmakers in Iran are considering a proposal to make the death penalty automatic for those who leave

Lawmakers in Iran are considering a proposal to make the death penalty automatic for those who leave the Muslim faith.

Abe Ghafari of Iranian Christians International, Inc. (ICI) was at least a little surprised to learn the news. "Before, it was like an option that an Islamic judge could decide to use or not to use -- but now it will become an automatic thing. And from the language of the legislation, it seems like something that cannot be appealed," Ghafari contends.

The death penalty would primarily apply to those who convert to the Christian faith. "There are large numbers of conversions from Islam, maybe even in the tens of thousands every year, and this is causing concern in the Islamic circles in Iran," Ghafari explains.

People who use the Internet to convert people away from the Muslim faith will also be subject to the death penalty. Ghafari was asked if this information shocked him. "Yes, it does a bit because we do know that under Islamic law of Iran, there was always this option of issuing death penalties for any conversions from Islam. So this was already available, but it looks like they just want to escalate persecution – making the death penalty almost automatic for anyone who converts from Islam," Ghafari adds.

While Christians are the primary target, anyone converting to the Bahá'í faith will also face the death penalty. Ghafari sees trouble ahead, and is hopeful Christians everywhere will pray for the underground church in Iran.

Information on legislation provided by ICI about Iranian apostasy and the death penalty is available here.

Accused: The move would mean hook-handed cleric Abu Hamza would not be extradited to the U.S.

Britain should stop extraditing prisoners to America following the CIA’s admission that it ‘tortured’ terror suspects, an influential group of MPs has demanded.

The move by the Commons Foreign Affairs Committee would prevent the extradition of hook-handed cleric Abu Hamza, who faces terror charges in the US, and Babar Ahmad, accused of fund-raising for the Taliban.

Ministers have previously been willing to take at face-value statements from President George Bush that the US does not resort to torture.

But the committee says this should no longer be the case after CIA admitted the ‘waterboarding’ of three detainees.

The technique involving simulated drowning has already been described as torture by Foreign Secretary David Miliband.

The MPs say this has implications for extradition to the U.S. as the UK is a signatory to a United Nations convention barring the return of individuals to states where they are at risk of torture.

During waterboarding a detainee is bound to a board with feet raised and cellophane wrapped around his head.

Water is poured onto his face, making the suspect fear he will drown.

In February, the U.S. Director of National Intelligence, Michael McConnell, told a Senate committee waterboarding was ‘a legal technique used in a specific set
of circumstances’.

President Bush vetoed a bill which would have banned it, saying he did not want to deprive agents of valuable tools in the war on terror.

In April, Mr Miliband told the House of Commons: ‘I consider that waterboarding amounts to torture.

'The UK unreservedly condemns the use of torture.’

Today’s report by the Foreign Affairs Committee said there is a ‘striking inconsistency’ in Ministers’ continued acceptance of the Bush administration’s denial that it uses torture.

‘We recommend that the Government does not rely on such assurances in the future,’ said the committee.

The report also urged the Government to press the U.S. authorities for information on whether any American military flights landing in the UK were part of the ‘rendition circuit’, even if they did not have detainees on board.

The Government has repeatedly accepted U.S. assurances that UK territory has not been used for ‘rendition’ – the secret transfer of suspects between countries.

But in February, Mr Miliband said he had been informed by the U.S. that two rendition planes refuelled on the British territory of Diego Garcia in the Indian Ocean.

Today’s report highlights claims from human rights groups including Amnesty International that U.S. planes landing at UK airports were either on their way to pick up detainees for rendition or returning from delivering them.

The MPs also urged the Foreign Office to investigate allegations that Britain ‘outsourced’ interrogation of terror suspects to Pakistan’s intelligence agency.

It has been claimed six British nationals were detained and tortured in Pakistan, where they were also interrogated by British intelligence officers.

Foreign minister Lord Malloch-Brown told the committee: ‘We absolutely deny the charge.’

Yesturday, I was listening to the news and I heard a statement which is, tragically, not uncommon in news about warfare: Civillians had been killed, including women and children.

What can we take from a statement like that? To me, the implication is that the women involved were less deserving of slaughter than the men. It seems that the men are viewed as somewhat legitimate targets, despite their status as civillians.

The lives of men are as precious as those of women. There is no justification for this sort of message, which tells men that violence against their sex is fundamentally more acceptable than violence aganist women. There is no justification for the almost super-human levels of bravery and self-reliance that men are expected to show when threatened. There is no justification for that the way that violence against men is tollerated, that individual men are presumed to be complicit in violent exchanges unless proved innocent, while violence against women is presumed to be unacceptable in almost any circumstances. There is certainly no justification for a lack of compassionate, heartfelt grief over every civillian, regardles of their sex, who has ever lost their lives to war.

As with almost every form of sexism, both men and women suffer a disservice. When men as a whole are seen as the more acceptable target for violence, the ability of women to present a legitimate threat is dismissed. This is patronising and insulting to women, as well as dangerous for anyone who really thinks that all women lack aggression or capabiliy when it comes to physical violence! However, this issue is not primarily about women's rights, but men's.

The issue of violence against men is one of the reasons why, no matter how much I support the struggle of the world's many wonderful, insightful feminists to end sexism against women, I will never be a feminist. Surely, any permanant focus on one sex's rights above that of others' is sexist in itself. Sexism affects all of us, male, female and transgender. Unfortunately, there is pleanty of it to go around! Every person deserves protection from the various forms of hatred and discrimination directed against their sex.

The unpeaceful conquest of America continues to curse the US. It is at war with somebody all the time, openly or hidden. The livly tradition of war has twisted the Amercian DNA and nervous system, and the US government passes on the tradition of the natives to torture their enemies. Its like a mental virus passed on from the violently subdued enemy to his conquerer, a last signature that eventually destroys the conquerer’s civilization from within: Wrong doings deforms the nervous system as stress, stress limits the mind, and partial minds destroy the Whole. The one who laughs last, laughs most joyfully. That is the land itself, it multiplies whatever you saw.

Editorial : PF SCAM SHAME SHAME TO CORRUPT JUDGES & POLICE IN INDIA

- WHO WILL BELL THE CORRUPT FEW AMONG INDIAN JUDICIARY & INDIAN POLICE ?

Just a few months back , a district & sessions judge in mysore was arrested for swindling the court money to the tune of approx 20 lakhs , now comes the provident fund scam involving judges . these are only tip of the ice berg , there lies lot more scams beneath. Add to it , the recent raids of Karnataka lokayuktha on high ranking police officials who have amassed crores worth illegal wealth. Police officer extracts bribe from criminals for destroying prosecution’s case , for manipulating evidences , to fix up innocents in cases while letting free the real criminals , to file B report , to close prosecution cases , to finish innocents in fake encounters , to apply 3rd degree torture on innocents , etc . where as a judge takes money for giving favourable judicial orders to the real criminal.

All these goes to prove false , the public perception that persons behind bars are the only criminals & those outside are good ones. There are poor innocent people wrongly convicted & behind bars & much more number of criminals outside. More shocking is that there are ruthless , cunning criminals in public offices as police , as judges & doing more harm to the society , people & the nation at large . these corrupt public servants are greater threat to india’s national security & internal security than any terrorist outfits or Pakistan or china.

The honourable chief justice of India , union home minister & director general of police for Karnataka even failed to answer the open questionnaire in full with truthful answers , lest the truth comes out , lest the criminals in public offices are brought to book.

They even failed to accept my appeals as public interest litigations ( PIL ) or to accept my conditional offer of services in apprehending criminals , lest their cronies , criminals are caught red handed.

Is this the free India our freedom fighters , bapuji & others struggled for , sacrificed for ? there was a time when JUDGES , POLICE were considered as equivalent to GODS themselves , but now some corrupt JUDGES , POLICE themselves are proving that they are not human beings but worse than DEMONS. The criminal acts of corrupt majority is bringing disgrace to the honest few in judicial & police service & to the institution as a whole. We at e-voice of human rights watch salute , respect those honest few in judicial & police service and requests them to apprehend their corrupt colleagues at the earliest.

When the fence itself eats into the crop which it has to protect , when the doctor himself kills the patient whom he has to treat , when the mother supposed to protect her child kills it herself , when the king supposed to protect his subjects himself kills them , WHEN THE POLICE & JUDGE SUPPOSED TO GIVE JUSTICE , PROTECT HIS CITTIZENS , HIMSELF MEATS OUT INJUSTICE , where to appeal ? it is nothing but anarchy. These corrupt few are also bringing disgrace to the august institutions they occupy & are also making contempt of those very offices they hold & making contempt of citizens of India.

Who will dare to bell the fat , corrupt cats & save democracy in India.

Your's sincerely,

Nagaraj.M.R.

INDIAN JUDICIARY UNDER RTI PURVIEW

The corrupt among public servants always give a ruse , reason to escape from accountability. Recently government of Karnataka under president's rule has enacted a rule limiting the number of informations sought in RTI application to 3 . already bureaucrats are successful in exempting official file notings from RTI purview. These file notings are the basis on which official decisions are taken by superiors , so if one wants to know the intention behind an official decision it is imperative to know all the notings.

Police apply 3rd degree torture on accussed , ask questions for hours in the name of extracting truth , the same police are afraid to answer questions lest the truth come out.

In the courts of law , numerous questions are asked , cross examination done to extract truth . if one remains silent it amounts to confession / agreeing to all charges leveled. In courts of law , during cross examination one must give straight forward answers , one cann't give vague answers nor state excuses for not answering a question. If one doesn't give straight forward answers that also is considered as agrreing to the charges levelled. The courts go to any length to extract answers to it's questions , take for example rape cases in the backdrop of our Indian tradition. In the courts of law , the rape victim - woman who has already suffered injustice , shame is made to depose before male judges , lawyers who are total strangers and made to repeatedly explain how the crime of rape was committed. So once again the victim is made to suffer more shame in the society. For the courts answers to questions , cross examination , legal procedures is more important than honour of woman. The very same judges are afraid to answer questions , cross examination under one pretext or the other lest the truth come out.

Even our people's representatives – MPs , MLAs , etc are afraid to speak out truth , to honour RTI act citing legal privileges , etc. in India , during appointment of persons to government service back ground check & clearance by police is mandatory & during appointment into sensitive defense , space , atomic energy establishments , etc apart from police verification , investigation by intelligence agencies is a must. No such thing for our MLAs , MPs . However now criminalization of politics is almost in India , some of the accussed are drafting laws like IPC , Indian defense rules , police code , purviews of judiciary , etc. they are drafting laws to legalise their crimes. The election commission of India is not properly verifying the affidavits of candidates , also the vigilance authorities , lokayukthas are not properly verifying the affidavits of sitting MLAs , MPs , etc.

More than RTI ACT , to seek information is part of every Indian citizen's fundamental rights & human rights , RTI ACT is just fulfilling that right partly & fixing a time frame. Nobody , no constitutional functionary is higher than Indian citizens , nobody's privileges or any laws prevailing over the fundamental rights & duties of Indian citizens is constitutional , just or legal . The shame is that even after 60 years of independence , FUNDAMENTAL RIGHTS & DUTIES OF INDIAN CITIZENS is observed more in breach than implementation , by our public servants including the judiciary .

Hereby , we urge all the public servants – judges , police , people's representatives to honour RTI ACT , to honour Indian citizen's fundamental & human rights and to facilitate them to perform their fundamental duties. The silence of public servants to the questions asked or vague answers , ruses by public servants amounts to confessions , agreeing to the questions , charges leveled & crimes committed .

Your's sincerely,

Judiciary under RTI Act, says parliamentary panel

New Delhi, April 29
A parliamentary committee today held that judiciary comes under the purview of the Right to Information law with regard to all activities of administration except "judicial decision making." "Except the judicial decision making, all other activities of administration and the persons included in it (judiciary) are subject to RTI Act," said the report of the Parliamentary Standing Committee on Personnel, Law and Justice.

The opinion of the committee headed by E.M. Sudarsana Natchiappanan comes against the backdrop of a raging controversy over whether the judiciary comes under the RTI purview. Chief Justice of India K.G. Balakrishnan had recently said the CJI is a constitutional authority and does not come within the purview of the RTI Act.

The committee, which went into the demands of grants for the personnel ministry and discussed the interpretation of Section 2 (h) of the RTI Act, that is, definition of public authority, said the provision is very clear that all constitutional authorities come under the definition of public authority. The committee had examined in detail every clause of the RTI Act, 2004 and was conscious of the fact that all wings of the state, executive, legislature and judiciary, are fully covered under this Act since all organs of the state are accountable to the citizens of India in a democratic state. "It is more so since the judiciary is having a dual role as (i) administrative function and (ii) judicial decision making.

JUDGES IN PROVIDENT FUND SCAM ?

NEW DELHI: Faced with accusations having the potential to unhinge the traditional public perception of the judiciary's clean image, the SC on Monday decided to examine the possible mode of probe into the Rs 23 crore illegal PF withdrawal scam allegedly involving 23 judges, including some from the HCs and one from the apex court.

The difficult question on the mode of probe was posed by a petitioner, who is the chairman of Advocates Welfare Trust and Bar Association of Ghaziabad — the place where the scam took place — even as CJI K G Balakrishnan had shown faith in the integrity of the judges by asking the UP police, which is probing the scam, to send questionnaires to the judges, whose names allegedly figured in the scam.

Unwilling to have the judges interrogated by the police at first go, SC had written to the UP police that if the response of those judges to the questionnaire did not satisfy the probe team, then it could send request for personal interrogation.

The request for interrogation in person would be considered on merit, the SC had told the police in a communication. Appearing for the Bar, senior advocate Fali S Nariman flanked by senior advocates Anil Divan and M N Krishnamani expressed concern over the scandal and also pointed out the possible dent in the image of the judiciay if an SHO was seen interrogating a judge.

Bench comprising CJI Balakrishnan and Justices P Sathasivam and J M Panchal appeared undecided about the constitution of a committee as suggested by Nariman, it decided to seek the assistance of solicitor general G E Vahanvati to chart out a possible course to deal with the situation.

To keep the proceedings off the media glare, the bench decided to take up the matter in chamber on July 14, when Vahanvati and other senior advocates would make good their assistance to look for a way out of the problematic situation.

The petition said one Ashutosh Asthana, the Central Nazir in the judgeship of Ghaziabad, had allegedly confessed before a magistrate about his role in the PF scam and had allegedly mentioned the names of 23 judges who were beneficiaries of the ill-gotten money.

Failure of RTI Act in India

- In the clutches of corrupt public servants mafia

In the courts of law , every statement to be valid must be supported by evidences. That too, the statements of public servants / government officials & their reports in government records are considered as sacrosanct , the ultimate gospel truth by courts of law.

The corruption has spread it's tentacles far & wide in the public service. The bribe booty is shared by lower to higher officials. If an official is complained against , his higher official conducts a formal investigation & reports in the record that lower official is not guilty.

The vigilance authorities / Karnataka lokayukta has recently raided on police , tax officials & seized illegal wealth amounting to crores of rupees. Take the recent case where in senior IPS officer , superintendent of police chamarajanagar , mr.srikantappa was arrested by Karnataka lokayukta. The victims spoke to media that he used to threaten them with false cases. In this way , how many victims / innocents were arrested & tortured by his arrest warrants ? how many innocents suffered in false cases ? how many rich criminals got scot free , by srikantappa's filing of B reports leading to closure of cases ?

In the past how many suffered by srikantappa's actions ? has the court subjected to review all the previous actions of srikantappa throught his corrupt career ? if not , why ?

The courts of law has taken the official reports , records of mr.srikantappa as gospel truth & indirectly aided rich criminals & harmed innocents. It is the same case with respect to reports of all government officials – police , labour , tax , etc. the rich criminals buy out government officials & make them write favourable report about themselves. Whereas the poor , innocents suffer from adverse reports & injustices. The courts of law takes the government records at it's face value & meat out injustices to the poor , innocents while aiding the rich criminals.

When a commoner requests for information as per RTI Act , the government officials either give incomplete information , false information or decline to give information under one pretext or the other. The officials are damn sure that the truthful information will be detrimental to themselves & will be taken as evidence against themselves in the courts of law. So information , truth is not given. Even information commissions are failing here. Thereby, the public are denied to seek justice in the courts of law , by lack of evidences.

The courts of law before accepting the records of government officials , must subject it to a "test of truth". When a government report is contested against , a fact finding team comprising members of public , complainant , respondent & the court , must check it out at the ground level. Orelse when a complainant says that the report of a government official – police , labour , tax , etc as false that government official must be subjected to lie detector test , narco-analysis, ertc by court of law. The questionnaire ie the questions to be asked during the scientific test are to be prepared with feedback from both complainant & respondent's side. In that way , impartially truth can be found out. After all , the objective of courts of law is "Quest for Truth", not just giving out judgements based on reports of corrupt officials.

Nowadays , we are even seeing reports of corruption among the judiciary itself. If a complaint against a judge is made out that a level ground is not provided to put up one's case in the court or cross examination of one party is not allowed or lie detector test / narco analysis of one party is not allowed ( in turn taking the lies of that party as truth ), the judge making a varied interpretation of law, the judge not safe guarding the health & life of the complainant in the custody of police leading to 3rd degree torture of complainant by police , etc, in all such cases the supreme court of India must change the presiding judge of such cases , the cases must be thoroughly reviewed & the guilty judge must be subjected to narco-analysis , lie detector test , etc & legally prosecuted. In this back drop , accountability of police & judges to the public ie citizens of India – kings of democracy , is a must. After all , the kings of democracy / citizens of India / taxpayers are the paymasters of all public servants.

We at e – voice of human rights of watch have utmost respect for the judiciary & all government institutions. It is the corrupt few in those institutions who are themselves bringing disgrace to the august institutions they occupy , by their corrupt deeds. The saving grace is that still honest few are left in public service & it is an appeal to them , to legally prosecute their corrupt colleagues.

In India , the private enterprises are the wealth creators of our economy. However , some private enterprises are violating labour laws , tax laws , human rights & fundamental rights of people. In turn harming the public , looting the tax dues. This is creating black money causing various social evils in the society. These huge private enterprises take loans from public sector banks ie take public's money as loans , collect money from public in the form of shares , debentures , sell their product to the public. Still , they are not covered by RTI Act, they don't give truthful information to the public nor allow public inspection of their sites , why ? they buy out concerned government officials & gets them to write favourable report about themselves. There are wide differences between the ground reality & these government reports. If the aggrieved person , victim of injustices meated out by these private enterprises , tries to legally seek justice, these criminal private enterprises buy out police , concerned officials & fixes up the victim in false cases. The police in total disregard to law violates the human rights & fundamental rights of the victim in custody , subjects the victim to 3rd degree torture in custody. The presiding judge of the case doesn't safe guard the rights , health , life of victims in custody. The judge doesn't check out the truthfulness of government reports & passes on judgement making varied interpretation of just remember the case of "local citizens vs coca cola company" in plachimada , kerala.

Is it not right & just in such cases , to subject the presiding judge , police , concerned government officialds & most importantly key officials of that criminal private enterprise to lie detector , narco- analysis tests , to know the truth ? is it not right to conduct the inspection of alleged site , review of all company's records , by a team comprising of members from public , court , complainant & respondent ?

Some of these criminal enterprises threaten to finish off the poor victims . as these company's have money power they can buy out rowdies , police & capable of doing anything. In such cases , if anything untoward happens to the victim or his family , are not the officials of such criminal enterprise liable to pay compensation to the victims's family or survivors ?

In India , do we truly have democracy & freedom ? is this corrupt India – what our freedom fighters dreamt of & fought for ?
